The Individuals with Disabilities Education Act (IDEA) is a federal law that guarantees eligible students with disabilities the right to a Free Appropriate Public Education (FAPE) through individualized services, evaluations, and an Individualized Education Program (IEP). It also provides legal protections for families, including the right to participate in decisions, receive Prior Written Notice (PWN), and use dispute resolution processes such as mediation or due process.

While IDEA is designed to protect students, it is a highly procedural system with strict timelines, documentation requirements, and legal processes that families are often expected to navigate to secure appropriate supports.

Section 504 of the Rehabilitation Act is a federal civil rights law that prohibits disability-based discrimination in programs and activities that receive federal funding, including public and public charter schools. It requires schools to provide students with disabilities equal access to education through accommodations, supports, and services, ensuring their needs are met as adequately as those of nondisabled peers.

Section 504 also guarantees protections such as evaluation, placement procedures, and the right to a free appropriate public education (FAPE), with enforcement through civil rights processes rather than special education law. 

The U.S. Department of Education’s guidance on the ADA Amendments Act of 2008 explains how federal disability law expanded the definition of disability under Section 504 and the ADA, requiring schools to interpret eligibility broadly and focus less on whether a student “qualifies” and more on whether their needs are being met. It clarifies that disabilities are not limited to learning and may affect a wide range of major life activities, that students must be evaluated when a disability is suspected, and that schools remain responsible for providing a Free Appropriate Public Education (FAPE) and procedural protections under Section 504.
